We Violate the Constitution to Save the Constitution


Yes, that’s the logic used by two law professors in the New York Times yesterday to urge the President to unilaterally raise the debt limit.  Sounds a lot like this now infamous moment.

Why do supposed smart people continue to make asinine statements like this?  Probably because many Americans continue to fall for the, “We have to do something” straw man argument.  Consider global warming, population growth, global freezing, obesity, hunger, homelessness…terrorism, foreign policy, drugs, definition of marriage. Left or right, it doesn’t matter.  The issue doesn’t matter. The phrase of the day is “the ends justify the means.”

Let’s take our two lawyers in the Times editorial for instance.

Our argument is not based on some obscure provision of the 14th amendment, but on the necessities of state, and on the president’s role as the ultimate guardian of the constitutional order, charged with taking care that the laws be faithfully executed.

In other words, we know the 14th Amendment provision is a big stretch so just do it “for the country”.  Look at that sentence. These d-bags are saying the President should violate the constitution in order to “take care that the laws be faithfully executed.”  That’s like saying I had to cheat on my wife in order to be faithful to her.

A deadlocked Congress has become incapable of acting consistently; it commits to entitlements it will not reduce, appropriates funds it does not have, borrows money it cannot repay and then imposes a debt ceiling it will not raise. One of those things must give; in reality, that means that the conflicting laws will have to be reconciled by the only actor who combines the power to act with a willingness to shoulder responsibility — the president.

Oh for craps sake!  These guys hold up Obama as the savior of consistency in doing what he says he’ll do.  What world  do these people live in.  Here is  the record of our current president’s consistency.

  • Get out of Iraq: we’re still there
  • Win in Afghanistan: bogged down
  • Nobel peace prize winner: get us involved in a mess in Libya
  • Close Guantanamo Bay: still open
  • Rescind DADT: okay, he did that.  Well until his administration asked to belay that order for a while
  • End the Patriot Act:  Fought to extend it twice

No gentlemen, we don’t need this man, or any president for that matter,  grasping more unilateral power.  We need to neuter the office not expand it.
